1. Definitions
In these Terms, the following words carry the meanings given below:
- "Agreement" — these Terms & Conditions, together with any written assessment or service plan we provide.
- "We", "Us", "Our" — Sila Wela, 134 Thanon Utarakit, Pak Nam, Krabi 81000, Thailand.
- "You", "User", "Client" — the individual or entity engaging our services or visiting our website.
- "Service" — any watch repair, servicing, or restoration work we undertake on your behalf.
- "Watch" — the timepiece or timepieces you entrust to our care.
- "Assessment" — the written condition report and cost estimate we provide before work begins.
- "Content" — text, images, and other material on our website or in communications from us.
2. Acceptance of Terms
By leaving a watch with us, submitting an enquiry through our website, or otherwise engaging our services, you confirm that:
- You have read and understood these Terms.
- You are at least 18 years of age, or have the consent of a parent or guardian.
- You have the legal capacity to enter into a service agreement.
- You are the owner of the watch, or have written authority from the owner to bring it for service.
If you do not agree with any part of these Terms, please do not leave your watch with us or proceed with an enquiry.
3. Service Description
Sila Wela offers the following repair and restoration services from our workshop in Krabi, Thailand:
- Routine Care Service — cleaning, lubrication, and rate regulation.
- Dial Refresh & Hand Service — cosmetic cleaning and hand renewal or replacement.
- Complete Heirloom Restoration — comprehensive movement and case work for inherited or collectible watches.
We accept watches in person at our Krabi workshop. Remote enquiries are welcome by phone or email; however, physical assessment is required before any work commences.
Availability of services may be subject to workload and the nature of the watch presented. We will advise you at assessment if we are unable to assist.
4. User Responsibilities
When engaging our services, you agree to:
- Provide accurate information about the watch and its history to the best of your knowledge.
- Disclose any known damage, modifications, or prior repairs.
- Notify us of any sentimental or financial value so we may take appropriate care.
- Collect or arrange collection of your watch within 30 days of our notification that work is complete.
- Pay any agreed fees before the watch is returned.
Prohibited activities when using our website include:
- Submitting false or misleading information through our contact form.
- Attempting to access systems or data beyond what is necessary for ordinary enquiry.
- Using our website content for commercial purposes without prior written consent.
- Any action that could damage our reputation or interfere with our services.
5. Intellectual Property
All content on our website — including text, photographs, design elements, and the Sila Wela name — is our property or used with permission. Nothing in these Terms transfers any intellectual property rights to you.
We grant you a limited, non-exclusive, non-transferable licence to view website content for personal, non-commercial use only. You may not reproduce, copy, or distribute our content without prior written permission.
We do not claim ownership of photographs or images you send to us for assessment purposes. Such materials will be used only to evaluate and carry out your requested service.
6. Payment Terms
Our service fees are quoted in Thai Baht (฿). Quoted prices are inclusive of labour unless otherwise stated.
- A written assessment and cost estimate is provided before any chargeable work begins.
- You are under no obligation to proceed after receiving the assessment.
- Any replacement parts required are agreed in advance; costs are included in the assessment.
- Full payment is due upon collection of the watch.
- We accept cash in Thai Baht. Please enquire about other payment arrangements when you visit.
Assessment fee: A modest bench fee may apply if a watch is brought in for assessment and you choose not to proceed with the service. This will be communicated to you at the point of assessment.
Service warranty: We stand by the quality of our work. Should a fault arise directly related to the service completed, we invite you to return the watch within 6 months for review at no additional charge. This applies to workmanship only and does not extend to accidental damage or new faults unrelated to the service performed.
7. Service-Specific Terms
Condition disclosure: You are responsible for informing us of any known issues. We are not liable for pre-existing damage that was not disclosed and not identified during our assessment.
Parts and originality: Where original parts are no longer available, we will advise you and agree on alternatives before proceeding. We respect the original character of each watch and will not substitute parts without your express agreement.
Scope changes: Should assessment during repair reveal additional issues not identified at the outset, we will pause work, inform you, and obtain your agreement before continuing. Additional costs, if any, will be agreed in writing.
Uncollected watches: If a watch is not collected within 30 days of notification that work is complete, we will make reasonable attempts to contact you. After 90 days without contact, we reserve the right to charge a storage fee and, in exceptional circumstances where contact cannot be established after 12 months, to dispose of the watch in a manner consistent with Thai law.
Turnaround times: Estimated completion dates are given in good faith. Complex restorations, parts availability, and workshop volume may affect timing. We will keep you informed of any significant changes.
8. Disclaimers
Our services are provided with care and skill; however, watchmaking involves inherent risk, particularly with aged or fragile components. By accepting our assessment and authorising work, you acknowledge:
- Watches with very worn or brittle parts may require additional intervention that cannot always be foreseen.
- We cannot reverse the natural age or patina of a watch except where cosmetic service is agreed.
- Website content is provided for information only and does not constitute professional advice for a specific timepiece.
- We do not represent that all watches can be restored to full working order; outcomes depend on condition and parts availability.
9. Limitation of Liability
To the extent permitted by Thai law, our total liability to you for any claim arising from a service shall not exceed the total amount paid by you for that specific service.
We are not liable for:
- Indirect or consequential losses, including loss of sentimental value beyond any agreed insurance valuation.
- Delays caused by parts availability, third-party couriers, or circumstances outside our control.
- Damage caused by undisclosed pre-existing conditions in the watch.
- The failure of aged components that were in a fragile state at the time of service.
Nothing in these Terms limits liability for death, personal injury, or fraud caused by our negligence, as required by applicable Thai law.
10. Indemnification
You agree to indemnify and hold Sila Wela harmless from any third-party claims, costs, or damages arising from your misrepresentation of ownership, fraudulent instructions, or breach of these Terms. This includes reasonable legal fees we may incur in defending such claims.
11. Termination
By you: You may cancel a service at any time before work commences. Once work has begun, you may still request that we stop; however, you will be responsible for any reasonable costs incurred up to that point.
By us: We may decline to continue a service if we discover undisclosed conditions, if the required parts are unavailable, or if proceeding would be impractical. In such cases we will contact you promptly and return your watch.
Terms that relate to ownership, payment for work already done, intellectual property, and dispute resolution survive termination of any service agreement.
12. Dispute Resolution
These Terms are governed by the laws of Thailand. Any dispute arising from a service will first be addressed through direct, informal discussion between you and Sila Wela, and we will make every effort to reach a fair resolution without recourse to formal proceedings.
If a satisfactory resolution cannot be reached informally within 30 days, disputes will be subject to the jurisdiction of the courts of Krabi Province, Thailand.
Thai consumer protection laws, including the Consumer Protection Act B.E. 2522 and relevant service regulations, apply to all transactions. Nothing in these Terms reduces any rights you hold under applicable Thai law.
13. General Provisions
- Entire Agreement: These Terms, together with any written assessment we provide, constitute the entire agreement between us for the relevant service.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full effect.
- Waiver: Our failure to enforce any provision on one occasion does not waive our right to enforce it on future occasions.
- Assignment: You may not transfer your rights under these Terms without our written consent. We may transfer our rights and obligations in connection with a sale or transfer of our business.
- Notices: Formal notices should be sent to us at the address or email below. We will send notices to the contact details you provide when submitting your watch or enquiry.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page. For significant changes, we will make a reasonable effort to notify clients with active service agreements.
Your continued use of our services after any change takes effect constitutes your acceptance of the revised Terms. If you disagree with the updated Terms, please contact us before proceeding with any new service.
